Terms of Service

These Terms of Service ("Terms") govern your access to and use of Foreman ("Foreman", "we", "us"), a software service that helps home-service contractors find and re-engage customers. By creating an account, you agree to these Terms.

1. Eligibility & Account

You must be at least 18 years old and authorized to enter into agreements on behalf of your business. You're responsible for keeping your login credentials secure and for all activity that happens under your account. If you suspect unauthorized access, contact us immediately at the address below.

2. Service Description

Foreman is an AI-assisted revenue intelligence platform for home-service contractors. The service drafts customer outreach in your voice, scores customer opportunity, and surfaces booking and reactivation prompts. You retain full approval authority over every message sent on your behalf.

3. Your Content & Connected Accounts

When you connect third-party accounts (Gmail, Google Calendar, Twilio, Jobber, or others), Foreman accesses the data you authorize via those providers' OAuth flows. You retain ownership of your customer data, message history, and account content. You grant Foreman a limited license to process this data solely to operate the service for you.

You're responsible for having the legal right to upload, sync, or contact the customers represented in your connected accounts, and for compliance with applicable communication laws (including TCPA, CAN-SPAM, and similar) when sending messages through Foreman.

4. Acceptable Use

• Do not use Foreman to send unsolicited bulk messages, spam, or any communication prohibited by law in the recipient's jurisdiction.
• Do not attempt to access other users' accounts, data, or connected integrations.
• Do not reverse-engineer, scrape, or attempt to derive source code from the service.
• Do not use the service to harass, defraud, or impersonate any person.

5. AI-Generated Content

Foreman uses large language models to draft messages, score opportunities, and extract structured information. AI output may contain errors. You are responsible for reviewing every draft before approving it for send. Foreman is not liable for the content of messages you approve and send.

6. Fees

Pricing terms apply during paid plans (currently in early access — see your account or contact us for details). Fees are non-refundable except as required by law. We may change pricing on at least 30 days' notice.

7. Intellectual Property

Foreman, the Foreman name and brand, the underlying software, and all related materials are owned by Foreman and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the service for your business during your subscription. Your customer data and account content remain yours.

8. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that AI outputs will be accurate. Use of third-party integrations is subject to those providers' terms; we are not responsible for their availability or behavior.

9. Limitation of Liability

To the maximum extent permitted by law, Foreman is not liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost data, or business interruption. Our total liability for any claim related to the service is limited to the amount you paid in the 12 months prior to the claim.

10. Termination

You may close your account at any time. We may suspend or terminate accounts that violate these Terms or pose a risk to the service or other users. On termination, we'll delete or return your data per the Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to your account address at least 30 days before they take effect. Continued use after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in California.
